Water Rights
· Riparian - Everyone shares equally.
· Appropriative – First come, first serve.
Safe Drinking Act
· Federal law that ensures safe drinking water for people.
· Sources such as rivers, lakes, reservoirs, springs, and ground water wells.
· Does not serve private wells serving less than twenty five people.
Public Trust Doctrine
Any natural resource, such as water or the beach, of the state or local governments is a public resource. The resource must be used to benefit everyone in the state, not just the government owning the resource.
AB939 (1989)
California law established the following:
Waste management priorities
1) Reduce
2) Re use
3) Recycle
4) Waste to Energy (WTE) , Land filling
RCRA, the federal land protection law, makes WTE its 4th priority, with landfilling last.
Toxic Substance Control Act (TSCA)
· Annual report of toxic releases
· Approval of new toxics (if company does not hear back from gov't agency, they can produce/sell toxic)
Resources Conservation and Recovery Act (RCRA) [Prevention of ground contamination]· Manifest
1) Generator
2) Transporter
3) Owner/operator
1, 2, and 3 are all are held to strict liability if there is a release of toxic waste.
Prop 65· Requires people to be warned for cancer and reproductive health risks.
